Registration and Accounts

To access certain features of the platform, you must register for an account and provide some private information.  You agree to provide accurate, current, and complete information during registration and to maintain the accuracy and security of this information as it relates to your own account.  You are also responsible for maintaining the confidentiality of your login credentials, the maintenance and security of your identifying information, and all activities that occur under your account or your password.

If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

We reserve all rights to terminate accounts, edit or remove content, and cancel orders at our sole discretion.

Free Trial

Due to the digital nature of our products and services, we do not offer any free trial periods; however, from time to time we may decide to offer free but limited access in both duration and the resources accessible during the free trial period, all of which are subject to change without notice and in our sole discretion.

Membership Fees and Payments

The MasterCRE platform offers membership tiers with different access levels.  By selecting a membership plan, you agree to pay the applicable fees for the duration of your subscription, which is “at will” and with no contractual obligations either express or implied by you or us.  Currently, payments are processed through Stripe and PayPal, with additional payment methods expected to be added to the Platform from time to time and may be subject to additional terms and conditions of those third-party services.

Membership Subscriptions and  Renewals

Memberships on the MasterCRE platform that are “monthly" or "annual" are subject to automatic renewals and using the payment method most recently registered on your account (“lifetime" memberships are one single up-front payment for lifetime access and therefore do not renew), but with no contractual obligations inferred or implied by you or us, and your monthly or annual payments are recurring and will automatically renew at the end of each respective term unless you cancel your subscription.  If you subsequently wish to re-join the platform, then your cost will be determined at the pricing-in-place at that time, with no credits, refunds, or adjustments applicable.

Refunds

Due to the digital nature of our products and services, payments for memberships and all digital products are non-refundable.

Cancellations

If you are on a "monthly" plan, you can cancel at any time, provided that you provide us with written notice (an email to: [email protected] is acceptable) before the 5th of the month you wish to cancel, we will immediately terminate your membership; otherwise, auto-billing will continue until such time that you formally notify us in writing of your intent to cancel. If you are on an “annual” plan, then we must receive your written cancellation at least 30 days prior to your renewal period.  If you are on a “lifetime plan,” no cancellations are necessary.  Regardless of your monthly, annual, or lifetime plan, no refunds, credits, or pro-rations, will be allowed, made, or honored by us.

Access to Digital Products

As part of your Membership, you may have access to various digital products, such as audio and video content, templates, courses, webinars, podcasts, spreadsheets, documents, PDF files, and many other resources related to commercial real estate.  These digital products are for personal use only and may not be shared, redistributed, or sold without the express written permission of MASTER CRE LLC.  Further, you have no ownerships rights in any of the content that you download, copy, use, or share though use of this Platform, with all rights reserved by MASTER CRE LLC, a Florida Limited Liability Company.

Intellectual Property Rights

All digital products and content on the MasterCRE platform, including but not limited to text, graphics, logos, icons, images, and software, are the sole property of MasterCRE or its content suppliers, and all are protected by intellectual property laws.  As part of your Membership, you are granted a limited, non-exclusive, non-transferable license to access and use the digital products for your personal or professional use.

You agree that all materials, products, services, and content, and in any form (digital, hard copy, verbal, etc.) provided on this website are, and will remain, the sole property of MASTER CRE LLC, and/or its affiliates, assignees, directors, officers, employees, agents, suppliers, or licensors, and including all copyrights, trade secrets, trademarks, patents, and other intellectual property.  You also agree that you will not copy, reproduce, re-publish, upload, post, transmit, or redistribute any of the content obtained from the platform or directly through MASTER CRE LLC’s intellectual property in any way, including electronic, digital, or new trademark registrations.

You retain ownership of any content you submit and/or share to the platform (e.g., posts, comments, files, etc.); however, by submitting such content, you grant MASTER CRE LLC a royalty-free and non-exclusive license to display, use, edit, modify, copy, transmit, and broadcast the content you upload and publish. For any issues that may concern intellectual property claims, we advise that you contact the respective company(ies) to reach an agreement; you are solely responsible for the content you submit and agree that it does not infringe on the rights of others or violate any applicable laws, copyrights, or trademarks.  Further, MASTER CRE LLC and/or its affiliates, assignees, directors, officers, employees, agents, suppliers, or licensors will not be held liable for any intellectual property violations or damages that may result from such third-party intellectual property claims, and you further agree to hold MASTER CRE LLC harmless from any claims that may arise.

Community Guidelines, Rules, and Code of Conduct

By participating in the Platform and all of its features (e.g., community, forums, chat rooms, groups, webinars, networking events, podcasts, webinars, coaching and training sessions, etc.), you agree to the follow the rules and code of conduct of the Community Guidelines presented here.

Privacy Policy

Your use of the Platform is governed by our Privacy Policy, which can be found here.  By using our Services, you consent to the collection, use, and disclosure of your personal data as described in the Privacy Policy.

Termination and Suspension

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without notice, if we believe you have violated these Terms, the Community Guidelines, or any other policies posted on the Platform, engaged in fraudulent activities, or harmed the MasterCRE brand, the platform, or any Members or users in any way, either intentionally or unintentionally.  Upon termination, your access to paid features and digital products will immediately cease, but any amounts due before the termination will remain payable to us.

No Warranties

The platform and all related content and services are provided "AS IS" without warranty of any kind, either express or implied, including but not limited to the accuracy, reliability, or availability of the Services.  We believe that all content available on the platform is true, authentic, and correct, but we cannot warrant, nor be liable, for any damage, loss, or repercussions resulting from the use of our content. The information provided on this Website is for general information, educational, professional training, and networking purposes only and is not intended as professional advice.  We make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or availability of the Website or the information, content, or services provided through it.  Your use of the Website is at your sole risk.  Seek diligent guidance from appropriately trained, licensed, and experienced professional advisors and consultants when contemplating the making of any investment or financial pursuits.

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Palm Beach County, in the State of Florida.  Any disputes or claims arising out of or relating to these Terms shall be resolved through binding arbitration in Palm Beach County, Florida, and you agree to waive any right to a jury trial.

Severability

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision will be severed from the remaining provisions, which will continue in full force and effect.

Disputes

Any dispute related in any way to your use of this website or to products you purchase from us shall be arbitrated by state or federal court governing over Florida, and you consent to exclusive jurisdiction and venue of such courts.

Indemnification

You agree to indemnify, defend, and hold harmless MASTER CRE LLC, its affiliates, officers, directors, employees, agents, preferred partners, and other members from and against any claims, liabilities, damages, legal demands, and expenses (including reasonable attorney fees) arising out of or in connection with your use of the platform or violation of these Terms, our Community Guidelines, or any of the policies of MASTER CRE LLC; we reserve the right to select our own legal counsel.

Limitation on Liability

To the fullest extent permissible by law, MASTER CRE LLC shall not be held liable shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of, or related to your use of, or inability to use, this Website or any linked site(s).  You also agree to hold harmless and indemnify MASTER CRE LLC, its officers, members, employees, assigns, and others for any damages that may occur to you because of your misuse of our platform or its contents. 

MASTER CRE LLC reserves the right to edit, modify, and change this Agreement at any time, and without notice or approval.  We shall let our users know of these changes either through electronic mail, a post of the Platform, text messaging to the phone numbers associated with each Members’ account, or a combination thereof.  This Agreement is an understanding between MASTER CRE LLC and the user, and this supersedes and replaces all prior agreements regarding the use of this website.  To the fullest extent permitted by law, MASTER CRE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use or misuse of the Platform or the content derived from it.

Entire Agreement

These Terms constitute the entire agreement between you and MASTER CRE LLC regarding your use of the Platform.
